The Rules of Advertising

Attention small business owners! As a fellow entrepreneur, I know that you want to make sure you're playing by the rules when it comes to advertising. That's why I'm sharing some important information about U.S. advertising laws.

The Federal Trade Commission (FTC) is the watchdog ensuring a fair and honest marketplace for businesses and consumers. Their rules protect against deceptive advertising and unfair business practices.

If you're using email to promote your business, you need to follow the rules outlined in the CAN-SPAM Act. This law sets requirements for email headers, subject lines, and letting recipients know where you're located. Plus, giving recipients the option to unsubscribe from their emails is crucial.

Selling through telemarketing? The Telemarketing Sales Rules and Telephone Consumer Protection Act are both important to follow. That means you need the appropriate disclosures and consent before you make that call.

Are you using customer testimonials in your ads? Make sure they're truthful and reflective of the typical customer's experience. And if you're paying for an endorsement, it must be disclosed.

Remember, these laws can be complicated. So if you're unsure if these apply to your business, seek expert counsel. Always make sure you're compliant and you'll be well on your way to advertising success!

I help entrepreneurs have access to expert counsel throughout the life of their business. Let’s have a collaboration call to see how we can help each other. Just put a wave in the comments and I will message you.
